What are the reminders if I apply LARIS?

1. If the application is found to have been falsified and incorrect, the application will not be accepted and will not be processed.

2. If the application is approved, all original documents and the original land title should be submitted to the Land Registration Section, at the respective district of the Land office. (Department).

3. Before submitting any application, the Applicant need to verify the (that) name/IC number of land owner in the land title document is consistent with the name on IC number. If it is not consistent, the applicant need to submit a separate application for ‘Land Title Amendment – Name/IC number’ at Land Department before applying Land Transfer of Ownership through LARIS.

Where can I make my payment for this matter?

An Outstanding Annual Rent Payment must be paid before submitting any land applications.

What are the application procedures?

1. Land Owner or the Lawyer should first register to e-Darussalam portal.

2. Choose the Type of Land Application.

3. Fill in the relevant Form Online.

4. Upload relevant original documents relevant scanned pdf format according to the checklist of (for) each application.

5. All the information provided must be true and correct before pressing “Submit”. If applicant is unsure, it is advised that the applicant press the “Save” button to store temporary information that has just been inputted. (Press “Save” button if unsure).

How can I register a property?

You can register your property in 4 steps:

1. Checking encumbrances. The lawyer first does a land search with the Lands Department to ensure the seller is rightful owner and entitled to sell the property. This is done to identify and check for any encumbrance – conflicting or added details of ownership that can potentially affect the legitimacy of a sale. The search costs a $1.

2. Submitting application for the transfer of ownership online. Through the Land Application and Registration Information System (LARIS) the buyer is required to submit the application for registering property online. , LARIS requires the user to have an e-Darussalam account.

3. Sign Memorandum of Transfer. Once an application has been received by the Lands Department, applicants will need to turn up to the Lands Department to sign the Memorandum of Transfer (MOT) after three days, which outlines the transfer of ownership. Applicants who fail to sign the MOT within 21 days after their applications received by Lands Department will not have their applications processed further.

4. Paying stamp duty. Stamp duty – a tax placed on the registering or transferring of assets or property – is the next step. The rate is currently $6 for every $1,000 of the value of the property (and an additional $1 as a registration fee). Once the transfer of land ownership has been approved, the Lands Department will notify the amount of stamp duty, and assign a date for payment.

5. Collect Title Deed. After the MOT is signed, stamp duty is paid, the Land Department will register you as the new landowner in the Land Registry and will issue a Title Deed, a legal document outlining ownership of the land. This will take approximately 5 days. Your lawyer will be notified to collect the Title Deed at the Lands Department.

Is there any Post-Approval Madatory Inspection?

A mandatory inspection will be held within 3-6 months after license approval has been obtained. This applies to all industries except for construction where inspections will be conducted both before and after license approval.

Inspections are held to ensure that all foreign workers in Brunei are being employed for the stated purpose.

What are the main requirements/application for Foreign Worker License?

There are few requirements prior to applying for Foreign Worker License

§ The company must first register with the Local Employment and Workforce Development Agency (APTK) to advertise their vacancy for a minimum of two weeks. During this time, interested job applicants may either apply directly to the company or via APTK

§ Upon any application by local job seekers, the company will have an additional 30 days to proceed with their standard recruitment procedures to review applications, conduct interviews and select a candidate

§ However, if there are no applicants within the 2 weeks, the company will receive a clearance letter from APTK within 3 days and may proceed to the Department of Labour to apply for a Foreign Worker License

§ Simultaneously, the company can log onto their Tabung Amanah Pekerja (TAP) account to print out the official list of local employees

§ Depending on the nature of business, the company may need to obtain a clearance letter from a relevant Government agency to validate foreign workers qualifications and the existing business premises. For more information, please visit www.labour.gov.bn

After the prerequisite steps are done, there are more steps in recruiting foreign workers.

1. Apply for Foreign Workers License. All new applicants must be submitted via a registered employment agent.

Applicants may visit the department of Labour to submit applications for a Foreign Workers License, together with all supporting documents required. The required documents are listed in the forms itself. Upon submission of the application a receipt is issued stating the date that the applicant may collect their approved Foreign Workers License, which will be within 7 working days.

Upon collection of the approved license, applicants are required to make payment for the security deposit. Payments are accepted in the forms of cash, Banker’s Guarantee or JITPA.

2. Apply for Visa. Applicants may now proceed to the Department of Immigration & National Registration to submit their applications for a Foreign Worker Visa, which is expected to be approved within 3-5 working days. Required documents include; application letter from the employer, Visa application form (Malaysians and Singaporeans are exempt), form 23, 2 copies of a current passport-size photo, photocopy of identity card (for Malaysians or Singaporeans), approved Foreign Workers License (original & a photocopy), Job Order from Department of Labour and employment agency representative card.

3. Medical Examinations. Once applicants have obtained their Visa and the foreign worker has arrived in Brunei Darussalam, they may proceed to the Ministry of Health to undergo the required medical examination, which typically takes one to two weeks.

4. Contract Signing. After passing the medical examination, applicants may return to the Department of Labour for the signing of their employee contract. This will be done within a day.

5. Apply for Work Pass. Upon signing their employment contract, the applicant may now return to the Department of Immigration and National Registration to apply for their work pass. This is expected to take around 3-5 days for approval. Documents required will be the same as the Visa application.

With the approval of their work pass, applicants may now proceed to apply for their own green IC card. Required documents include; identification card application form, travel document containing a photo page and a valid approved Work Pass form Immigration Department (original & a photocopy)

· Memorandum of Appointment of Power of Attorney stating the name and address of 2 or more individuals resident in Brunei Darussalam who are authorized to accept service of process and any notices, made under seal of the company incorporated outside Brunei Darussalam

· Company Resolution

· List of directors (Form IV(F))

What are the required documents for a Local Company?

How Do I Start A Business?

You can start a business in 1 day with just 2 steps.

1) Online name search and reservation. The first step in setting up a business involves conducting an online name search and reservation. This is to safeguard the originality of the business name and ensure that it is not already in use by another company. To conduct the search, you can set up an account at www.roc.gov.bn. Once the search has determined that the preferred business name is not already assigned, the chosen business name can be reserved at a nominal fee of $5, payable online.

2) Incorporation of company or register a business name. Once approval of the reserved business name has been granted, depending the type of company to be registered, you may proceed with either of the following:

· Incorporation of the company, for a flat fee of $300 (to register as Sendirian Berhad)

Or

· Register the approved business name for a fee of $30 (to register as a Sole Proprietorship)

Both may be done by logging back to your account at ww.roc.gov.bn, where the payments are easily payable online.

Depending on the nature and the type of business to be conducted, some companies may need to apply for their industry-specific license. Please check to verify whether this applies to your company.

Business License is no longer required for the majority of the businesses. Businesses are however required to comply with regulations and guidelines relating to the specific type of business activity.
